Last year, the High Court ruled that the “Right to Rent” scheme requiring landlords to check the immigration status of tenants was unlawful as it was discriminatory and breached Human Rights law.

The Court of Appeal has today allowed the Appeal by the Secretary of State for the Home Department and ruled that the “Right to Rent” scheme is lawful as it is both justified and proportionate.

Given this Judgement, landlords and their agents can continue using the scheme without fear that they are acting unlawfully.  It is, of course, possible that this case could be referred to the Supreme Court so watch this space!
